End User License Agreement (EULA)

Effective: Immediately upon download or use of the software

1. License Grant

Aptikube ("the Software") is licensed, not sold, to you by Modifried ("the Developer") for use only under the terms of this Agreement. The Developer reserves all rights not expressly granted to you.

Subject to your compliance with this Agreement, you are granted a limited, non-exclusive, non-transferable, revocable license to:

Download and install one copy of the Software on each device you own or control
Use the Software for personal, non-commercial purposes
Create and share user-generated content (levels, puzzles) made with the Software's tools

2. Restrictions

You may NOT:

Copy, modify, or create derivative works of the Software, except as explicitly permitted
Reverse engineer, decompile, or disassemble the Software
Remove, alter, or obscure any proprietary notices or labels on the Software
Sell, rent, lease, sublicense, or otherwise transfer the Software to third parties
Use the Software for any commercial purpose without express written permission
Use cheats, automation software, bots, hacks, mods, or any unauthorized third-party software

3. Ownership

The Software is protected by copyright laws and international treaty provisions. The Developer retains all right, title, and interest in and to the Software, including all intellectual property rights.

User-generated content created using the Software's level editor remains your property, but you grant the Developer a non-exclusive license to distribute such content through the Software's sharing features once a level is uploaded to the cloud. This license allows the Developer to maintain copies of your uploaded levels, even through a user deletion event, whether public or private.

You have sole control over whether your user-generated levels are considered for sharing on the Community Level Browser. The Community Level Browser is a solely opt-in experience where you can choose to publish your levels. By publishing a level, you agree to have your level available for any user of the Software to download a copy to their system memory for the use of playing the level. The downloaded level will only be stored within system memory for the duration of play and will not be stored on the users device. Any gameplay elements, puzzle based or not, contained within the level are free for other users to copy and adapt in their own user-generated levels. You do not own any concepts or gameplay elements developed in your user-generated levels.

4. Updates and Support

The Developer may, at their discretion, provide updates, patches, or support services for the Software. There is no obligation to provide any such updates or support.

Early Access builds are provided "as-is" and may contain bugs, incomplete features, or instability. By using Early Access builds, you acknowledge these risks.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

THE DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING OUT OF YOUR USE OF THE SOFTWARE.

IN NO EVENT SHALL THE DEVELOPER'S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE, OR ONE HUNDRED DOLLARS (USD $100) IF THE SOFTWARE WAS OBTAINED FREE OF CHARGE.

7. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this Agreement.

Upon termination, you must cease all use of the Software and destroy all copies, full or partial, of the Software.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [JURISDICTION - TODO: Developer to fill in], without regard to its conflict of law provisions.
